Efforts to Overturn the 2020 Election

The House Select Committee to Investigate the January 6th Attack concluded that Trump pursued what it described as a multi-part plan to overturn the 2020 presidential election.

The Committee documented:

  • Repeated promotion of false election-fraud claims
  • Pressure on state officials
  • Efforts involving alternate electoral slates
  • Pressure on Vice President Mike Pence concerning the electoral count
  • Efforts to mobilize supporters in Washington on January 6

The Committee concluded that Trump was the central cause of the events of January 6.

Fourteenth Amendment Litigation

Trump also became the subject of litigation under Section 3 of the Fourteenth Amendment.

The Colorado Supreme Court ruled that he had engaged in insurrection and was disqualified from the state's presidential primary ballot.

In 2024, the U.S. Supreme Court reversed that judgment on the ground that individual states do not have authority to enforce Section 3 against federal candidates. The Court did not independently decide whether Trump had engaged in insurrection.
