Documented activity

The Delaware Superior Court's March 31, 2023 summary judgment order found Fox's Dominion-related on-air statements false as a matter of law; the ruling addressed Fox's broadcasts, including Lou Dobbs Tonight, collectively rather than isolating a single dated segment. On December 10, 2020, Dobbs tweeted that the 2020 election was a "cyber Pearl Harbor," and a related broadcast/interview repeated a claim tying businessman Majed Khalil to an alleged Dominion/Smartmatic vote-rigging scheme -- Khalil separately sued Fox and Dobbs for defamation, a suit that was later settled.

Internal Fox communications made public in the litigation show Fox News President Jay Wallace privately describing Dobbs's program in derogatory terms even as it continued to air ("the North Koreans do a more nuanced show"; "we can barely contain Dobbs").

Fox Business canceled Lou Dobbs Tonight on February 9, 2021, one day after Smartmatic USA Corp. filed its $2.7 billion suit naming Dobbs; Fox stated the cancellation reflected previously planned programming changes unrelated to the suit.

Context

At a March 21, 2023 pretrial hearing, Judge Eric Davis remarked "There seems to be a Dobbs problem" after reviewing Fox's post-election coverage; Fox's own attorney responded that Dobbs was an "opinion host" about whom "it is abundantly clear he believed what he was saying" -- a characterization, by Fox's own defense, of sincere belief rather than knowing falsehood. No evidence reviewed establishes that Dobbs knew his statements were false at the time he made them. Dobbs died July 18, 2024. In the still-pending Smartmatic litigation, his estate's administrator, Debi Dobbs, has been substituted as a defendant in his place.
