The Delaware Superior Court's March 31, 2023 summary judgment order found that on-air and social-media statements about Dominion and the 2020 election broadcast across Fox programming -- including Lou Dobbs Tonight -- were false as a matter of law; the court's falsity ruling addressed Fox's Dominion-related broadcasts collectively, and left the question of actual malice for trial.

At a March 21, 2023 pretrial hearing, Judge Eric Davis remarked "There seems to be a Dobbs problem" after reviewing Fox's post-election coverage. Fox's attorney, Erin Murphy, responded that Dobbs was an "opinion host" about whom "it is abundantly clear he believed what he was saying."

Fox Business canceled Lou Dobbs Tonight on February 9, 2021, one day after Smartmatic USA Corp. filed a $2.7 billion defamation suit naming Dobbs, Maria Bartiromo, and Jeanine Pirro. A Fox spokesperson said the cancellation reflected programming changes planned before the lawsuit was filed.

On December 10, 2020, Dobbs tweeted that the 2020 election was a "cyber Pearl Harbor." A related Lou Dobbs Tonight broadcast/interview involving businessman Majed Khalil repeated a claim tying Khalil to an alleged Dominion/Smartmatic vote-rigging scheme; Khalil separately sued Fox and Dobbs for defamation over the broadcast, and that suit was later settled.
