On November 15, 2020, Bartiromo stated on air that Smartmatic "owns Dominion Voting Systems" and has "businesses in Venezuela, Caracas ... in Cuba, and ... links to China." Smartmatic and Dominion are, and were at the time, separate, unaffiliated companies; Smartmatic has never owned Dominion. In November 2020, Bartiromo also shared posts on her Parler account repeating unsubstantiated claims of vote "dumps" and that Dominion machines had been "seized in Europe"; a Fox executive is reported to have privately reacted, "I don't know why she invites this."
The Delaware Superior Court's March 31, 2023 summary judgment order found Fox's Dominion-related on-air statements -- including on Bartiromo's programs -- false as a matter of law, addressing Fox's broadcasts collectively.
